Our Privacy Policy
Property Solutions Place (PSP) recognise that your privacy is very important and we are committed to protecting the personal information we collect from you. The Privacy Act 1988 and the Privacy Amendment (Enhancing Privacy Protection) Act 2012 and Australian Privacy Principles govern the way we disclose and otherwise manage personal information about you.
PSP will ensure that all officers, employees and subcontractors are aware of and understand PSP’s obligations under the Act. We will achieve this through the provision of training and through maintaining and implementing internal policies and procedures to prevent personal information from being collected, used, disclosed, retained, accessed or disposed of improperly.
Definitions of Personal Information
Personal information is defined as information or an opinion that can identify or can reasonably identify an individual.
Personal Information Collected
PSP only collects information which is reasonably necessary for its dealings with the relevant individual. We may collect and hold personal information about you. The types of personal information we generally collect include but is not limited to:
Name;
Date of birth;
Residential address;
Postal address;
Email address;
Home phone number;
Work phone number;
Mobile phone number;
Your occupation and business address;
Individuals Tax File number;
Driver Licence, Passport, Photographic ID or photo and CCTV images;
Previous Utility provider bills in your name;
Financial information including details of your employer, income, name of bank or financial intuition and creditworthiness;
Details of your spouse, de-facto, dependent children, and roommates;
Details of properties owned by you; and
Information about the individual that is required by law.
We will not ordinarily ask you to provide sensitive information. However, there may be circumstances where the information provided by you reveals sensitive information. For example:
You may require a property with particular features, such as wheelchair ramps or wheelchair access. This may reveal health information;
In providing details of your spouse or de-facto partner, this may reveal sensitive information regarding your sexual orientation.
We will if it is reasonable or practicable to do so, collect your personal information from you. This may happen when you fill out a form or when you give us personal information in person, via phone, email, correspondence or our website.
Sometimes we will collect personal information from a third party or a publicly available source. We may need to collect personal information from credit reporting agency, your legal adviser, your past or current employers, your previous lessors or property managers, and tenancy information services or databases.
Failure to Provide Information
If the personal information you provide to us is incomplete or inaccurate, we may be unable to provide you, or someone else you know, with the products or services you, or they, are seeking.
Use and Disclosure of Personal Information
Personal information collected by PSP will ordinarily be used for the purpose for which it was collected but also:
Assisting you to sell your property;
Assisting you to purchase a property;
Assisting you to lease a property (either as lessor or lessee);
Assisting you with payment or refund of a bond;
Assisting you with tenancy disputes;
Coordinating repairs or maintenance to a property owner or leased by you;
Recording or accessing information at the Residential Tenancy Authority;
Recording or accessing information on tenancy information services or databases;
Client and business relationship management;
Providing products or services that have been requested;
Third-party service providers, who assist us in operating the business;
Our related entities to facilitate our and their internal business processes; and
In some circumstances, the law may permit or require us to disclose personal information.
Security of Personal Information
PSP stores your information in different ways, including in paper, and in electronic form. The security of your personal information is important to us. We take all reasonable measures to ensure that your personal information is stored safely to protect it from misuse, loss, unauthorised access, modification or disclosure, including electronic and physical security measures. PSP has implemented strong security measures. All personal information is stored in a secure database itself not accessible to the outside world. Additionally all of your personal and business information, not just sensitive information, is restricted to only those employees who need it to perform a specific task.
Unfortunately, no data transmission over the internet can be guaranteed as totally secure. Whilst PSP strives to protect your personal information, we cannot guarantee and cannot ensure complete security of any information that you transmit or provide us through the internet. Accordingly, any personal information or other information that you transmit or provide to us is provided at your own risk.
Access to Personal Information
If you are aware that we hold personal information about you that is no longer accurate, complete or up to date please contact us (see contacting us section below).
You may access the personal information we hold about you by making a written request. We will respond to your request within a reasonable period. We may charge you a reasonable fee for providing access to your personal information. We may decline a request for access to personal information in circumstances prescribed by the Privacy Act, and if we do, we will provide you with a written notice that sets out the reasons for the refusal (unless it would be unreasonable to provide those reasons):
We believe that granting access would pose a serious threat to life, health or safety of an individual, or to public health or public safety;
Granting access would have an unreasonable impact upon the privacy of other individuals;
Denial of access is required or authorised by law or by a Court or Tribunal order;
Giving access would be unlawful;
Legal proceedings are underway or anticipated and the information would not be accessible by way of the discovery process in those proceedings;
Giving access would reveal our intentions to negotiations between us and you in such a way as to prejudice those negotiations;
Giving access is likely to prejudice enforcement related activities conducted by, or on behalf of, an enforcement body;
Giving access is likely to prejudice action being taken or to be taken with respect to suspected unlawful activity or serious misconduct relating to our functions or activities; and
Giving access would reveal information in connection with a commercially sensitive decision-making process.
Complaints and Feedback
If you wish to make a complaint about a breach of the Privacy Act, APPs or a privacy code that applies to us, please contact us as set out below and we will take reasonable steps to investigate the complaint and respond to you. If you are not happy with our response, you may complain directly to the Australian Information Commissioner.
